On July 1, 2023 Minnesota Statute 151.72 https://www.revisor.mn.gov/statutes/cite/151.72/pdf went into effect, allowing adult consumers who are 21 and older to buy edibles and drinks infused with moderate amounts of hemp derived THC. Hemp derived THC is now limited to 5 milligrams per serving and 50 mg per package in food and beverages, an amount that was not previously allowed under state food and beverage law.
The change is widely being viewed as relaxing restrictions on hemp derived cannabinoids such as THC, however, this new law diminishes previously-unregulated hemp derived THC-isomers named delta-8 and delta-10 under much tighter regulations. This new law also includes new standardized testing, packaging and labeling requirements for hemp derived cannabinoids.
Previously:
No childproof packaging or age restriction to buy or sell.
No restriction of potency/number of milligrams per piece or per package
No Full Panel Testing to include molds/heavy metals.
Testing could be done at the plant level
New Law:
Packaging and labeling requirements now include
Opaque, childproof packaging and prohibits any packaging that could be deemed attractive to children.
Creates packaging and labeling requirements for cannabinoid products;
Prohibits packaging attractive to children, and the addition of cannabinoids to commercially available products;
Places on age restriction of 21 years old on sales of cannabinoid products;
Limits the content of any THC to 0.3%, up to 5 mg per serving and 50 mg per package (previously, there was not a mg limit for Delta-9 THC, and other THCs were not restricted to 0.3%); and
Requires testing of final product prior to sale, better protecting consumers from residual solvents and contaminants from the processing of raw hemp material.
